Terms & Condition for AAA Student Rental

1. Introduction

Welcome to the AAA Student Rentals website (“the Site”). By accessing or using the Site, you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the Site. These Terms constitute a legally binding agreement between you (“the User”) and AAA Student Rentals (“the Company,” “we,” “us,” or “our”).

2. Eligibility

The Site is intended for use by individuals who are at least 18 years old. By using the Site, you represent and warrant that you are of legal age to form a binding contract and that you have the necessary authority to enter into these Terms.

3. Services Provided

AAA Student Rentals provides a platform for students to browse and secure rental accommodation. The Site may include services such as:

  • Listings of available rental properties.
  • Tools to contact property managers or landlords.
  • Information regarding the terms of rental agreements.
  • Resources and advice on student accommodation.

All services are subject to change, and AAA Student Rentals reserves the right to modify, suspend, or discontinue any service at any time without prior notice.

4. User Responsibilities

As a User of the Site, you agree to:

  • Provide accurate, current, and complete information when using the Site.
  • Keep your login credentials confidential and secure.
  • Promptly update any information that becomes outdated or incorrect.
  • Use the Site only for lawful purposes and in accordance with these Terms.
  • Refrain from engaging in any activity that could harm the Site, its users, or the Company.

5. Property Listings

The property listings on the Site are provided by property managers, landlords, or third parties. While AAA Student Rentals strives to ensure the accuracy of the information, we do not guarantee that all listings are free from errors. Users are encouraged to verify the details of any property before entering into a rental agreement.

  • Availability: Property availability is subject to change without notice. AAA Student Rentals is not responsible for any discrepancies between the availability displayed on the Site and the actual availability of the property.
  • Virtual Tours and Images: Any virtual tours, images, or videos provided on the Site are for reference only and may not represent the exact condition or layout of the property.

6. Rental Agreements

Any rental agreement entered into through the Site is a contract between the tenant and the landlord or property manager. AAA Student Rentals is not a party to these agreements and is not responsible for any disputes or issues arising from the rental relationship.

  • Contractual Obligations: Tenants must review and understand all terms and conditions of the rental agreement before signing. Failure to comply with the terms of the agreement may result in penalties, fines, or eviction.
  • Lease Termination: Any early termination of a lease agreement must be handled in accordance with the specific terms outlined in the rental contract. Tenants may be subject to penalties or loss of deposits for early termination.

7. Payment Terms

Payment for rental services must be made in accordance with the terms specified in the rental agreement. Accepted payment methods may include bank transfers, debit orders, or other methods as agreed upon with the landlord or property manager.

  • Late Payments: Payments not received by the due date may incur additional fees, including late fees or interest. Continued non-payment may result in legal action or eviction.
  • Security Deposits: Security deposits are required for all rental agreements. The amount and terms of the deposit will be specified in the rental agreement. Deposits will be held in a trust account and will be refunded, minus any deductions for damages or unpaid rent, at the end of the lease term.

8. House Rules

Tenants are required to adhere to the house rules outlined in their rental agreement and in any additional documentation provided by the landlord or property manager. Violations of house rules may result in fines, penalties, or termination of the rental agreement.

  • No Alcohol: Alcohol is strictly prohibited on the premises.
  • Proper Use of Facilities: Tenants are not allowed to overload washing machines or use them to wash shoes.
  • Waste Disposal: All rubbish must be disposed of in designated bins. Failure to do so may result in fines.
  • Academic Performance: Grades are important and will be monitored. Tenants are expected to maintain a certain level of academic performance as part of their lease agreement.
  • No Intimate Relationships: Intimate relationships are not permitted on the property, and violations may result in disciplinary action.
  • Fines: A fine system will be implemented for violations of house rules, with fines ranging from R500 to R2000 depending on the severity of the violation.
  • No Sleepovers: Sleepovers are not allowed. Unauthorized overnight guests may result in fines or termination of the lease.
  • Surprise Inspections: The landlord reserves the right to conduct surprise inspections to ensure compliance with house rules and property maintenance standards.
  • Gate Codes/RFID Tags: Gate codes or RFID tags must not be shared with others. If lost, a new one must be purchased.
  • Security Cameras: Security cameras may be installed in common areas with the consent of the tenants.

9. Maintenance and Repairs

  • Tenant Responsibilities: Tenants are responsible for maintaining their rented space in good condition. Any damage caused by the tenant must be reported immediately and may result in deductions from the security deposit.
  • Landlord Responsibilities: The landlord is responsible for maintaining the overall condition of the property and addressing any necessary repairs. Tenants must report any maintenance issues promptly to avoid further damage.
  • Emergency Repairs: In the event of an emergency repair, tenants should contact the landlord or property manager immediately. The landlord will prioritize and address emergency repairs as quickly as possible.

10. Privacy Policy and Data Protection

 

10.1 Compliance with POPIA and DPA
AAA Student Rentals is committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA) and the Data Protection Act (DPA) of South Africa. By using the Site, you consent to the processing of your personal information as described in our Privacy Policy.


10.2 Data Collection

We collect personal information such as your name, contact details, and rental history to provide our services. We may also collect non-personal information such as IP addresses and browsing behavior.


10.3 Data Usage
Your personal information will be used to facilitate the rental process, communicate with you, and improve our services. We may also use your information for marketing purposes, but you can opt-out at any time.


10.4 Data Sharing
We may share your information with third parties such as property managers or legal authorities if required by law. We will not sell your information to third parties without your consent.


10.5 Data Security
We implement security measures to protect your information from unauthorized access, loss, or misuse. However, no online transmission or storage system can be guaranteed to be completely secure.


10.6 Data Subject Rights

As a data subject under POPIA and the DPA, you have the right to:

  • Access: Request access to your personal information held by AAA Student Rentals.
  • Correction: Request correction of any inaccurate, irrelevant, or outdated personal information.
  • Deletion: Request the deletion of your personal information under certain circumstances.
  • Objection: Object to the processing of your personal information for specific purposes, such as direct marketing.
  • Complaints: Lodge a complaint with the Information Regulator if you believe your rights under POPIA or the DPA have been violated.

11. Intellectual Property

All content on the Site, including text, images, logos, and design elements, is the property of AAA Student Rentals or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or otherwise use any content from the Site without our prior written consent.

  • User Content: If you submit content to the Site, such as reviews or comments, you grant AAA Student Rentals a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, and display that content.

12. Limitation of Liability

AAA Student Rentals is not responsible for any damages, losses, or injuries resulting from your use of the Site or the rental properties listed on it. This includes, but is not limited to, direct, indirect, incidental, punitive, and consequential damages.

  • Disclaimer: The Site is provided “as is” without warranties of any kind, either express or implied. AAA Student Rentals does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
  • Property Issues: AAA Student Rentals is not liable for any issues related to the rental properties, including but not limited to, maintenance problems, disputes between tenants and landlords, or any injuries or damages occurring on the property.

13. Indemnification

You agree to indemnify, defend, and hold harmless AAA Student Rentals, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your rental activities.

14. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by AAA Student Rentals. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that AAA Student Rentals shall not be liable for any damages or losses caused by your use of or reliance on any third-party content.

15. Changes to Terms and Conditions
AAA Student Rentals reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Site after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed of any updates.

16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
